Negligence test cases. In test cases for compensation brought by the claimant company against the defendant utility company for damage caused to the claimant's ducting, it was deemed necessary for the defendant to inform the claimant of the need to remove a section of its ducting so that the claimant's employees could attend the site within a reasonable time to assess the situation and thus to prevent any unnecessary damage to its ducting and the cabling within it, or at least to monitor and direct the means and extent of any temporary removal.
