Description
Where a local authority provides services pursuant to its obligations under section 2 of the Chronically Sick and Disabled Persons Act 1970 by exercising functions under section 17 of the Children Act 1989, the provision of those services is subject to rights to charge which are conferred by section 29 of the 1989 Act. A local authority may properly decline to provide services to meet the needs of disabled children until it has been demonstrated that, having regard to their means, it is not reasonable to expect their parents to provide such services.
