Sexual Abuse Victim Able to Pursue Claim to Substantive Trial:Swift J. held that the Claimant, a victim of sexual abuse by a teacher at a school he attended in the 1970s, was able to pursue his claim to trial in spite of the fact that it was statute barred by section 11 of the Limitation Act 1980. The Judge held that was equitable to disapply the limitation period pursuant to section 33 as substantial delay was not uncommon in cases of sexual abuse as victims were prone to suppressing their memories. The school's ability to defend the claim had not been materially affected and a fair trial on the issue of causation would be possible.
