Description

The pursuer had been supplied to work for the defenders by the third party. Case considers general principles of law that apply in cases where an individual has a contract of employment with one person but in pursuance of that contract of employment performs work for another person. The pursuers claim is based on alleged breaches of two statutory duties those contained in regulation 5 of the Provision and Use of Work Equipment Regulations 1998 and regulation 4 of the Electricity at Work Regulations 1989. The issue is whether the pursuer has stated a relevant case.
