Description

Barrister: A personal injury claim for mental distress against a barrister arising out of an alleged failure to introduce good character evidence in a criminal trial some nine years ago court was time barred. The judge should not have extended the limitation period under s. 33 of the Limitation Act 1980 as the delay was culpable and the prejudice to the barrister in having to rely on an expert's attempting to reconstruct the mental state of the Claimant some nine years previously and the uncertainty of the impact of the good character evidence could not be balanced.
