Damages where Accident Caused Claimant to Behave Criminally. A claimant whose personality changed as a result of the severe post-traumatic stress disorder he suffered as a result of the Ladbroke Grove rail crash, and who was convicted of manslaughter as a direct result of this, was unable to recover damages in respect of those aspects of his claim that were dependent on the manslaughter. This was due to public policy reasons based on the maxim of ex turpi causa. The test that had to be applied was whether the claim was so closely connected or inextricably bound to the criminal conduct that the court could not permit him to recover damages without appearing to condone that conduct.
