Description
Claims by the shareholders and directors of a company bringing a claim in respect of sub-lease were struck out on the basis that there was no interest proprietary or otherwise disclosed in their pleading. Claims by the company against Newham for nuisance were struck out because they related to aspects of the building outside of Newham's responsibility under the lease arrangements. All in all the obligation on a party seeking to amend its claim to set out its amendments clearly and coherently so that the Court and opposing parties might understand the true nature of the case being brought had not been met.
